Can I Record My Spouse And Use It In Court?
Lee Borden

Q.

Before a divorce, can a spouse record an audio conversation between the other spouse and another individual, without either parties knowledge or consent, and use it in a divorce case against the recorded spouse? I'm in Ohio.

These laws vary by state, so you'll need to check on the rules for your state. My favorite resource for this is the site provided by the Reporters' Committee for Freedom of the Press, at http://www.rcfp.org/taping/index.html. They have a taping guide with the individual laws by state.
