Getting Sole Custody While Dad's in Prison

Q. 

My son is four and half currently his father and I have joint custody. However, his father is in prison for 13 months. Can I request the court to grant me full custody while he is in prison?

A. 

I can't speak for your state. In mine, this would be a pretty simple question. You would be able to get sole custody easily. States vary, however, and you need to weigh the advantage of sole custody against the increased animosity from Dad that would almost certainly result from a move like this.
