
There is no private right of termination of parental rights in Oklahoma. If you want your fiancee to adopt your son, you have to be married over a year and then file for a step parent adoption. Your fiancee cannot be a felon, nor have any child abuse or neglect history, or any domestic violence history or it will probably not be approved.
You should go ahead and ask DHS to file a child support case. then when you are ready to file for the adoption, you can ask him to consent to the adoption and not have to pay any more child support. The father has to be notified of the adoption and can object. There are specific things that must be met before you can get an adoption without consent of the father. Failure to pay child support (court ordered) is one. Failure to maintain a relationship with the child is another. If you try to hide the child or do not tell him where you live or a phone number, he can use that against you a trial.
Adoption is a very complicated procedure but can be easily handled by a knowledgeable adoption attorney. I do a lot of step parent adoptions.
