Is It Child Endangerment to Run Out of Gas?

Q. 

My ex husband is already facing 2 counts of domestic assault and 1 count child endangerment. Last week he ran out of gas with my baby in the car on the highway. Is this considered child endangerment? It is extremely dangerous to be sitting on the side of the road on a highway waiting for someone to bring him gas.

Gosh I hope not. I know I've run out of gas 2-3 times over my life, and each time I had to do whatever was necessary to get gas so I could continue my travels. If one of my children had happened to be in the car with me, I would have had no way to transport them instantly to some safer or more comfortable place. I surely was negligent, perhaps even stupid. But I hope I wouldn't have been accused of child endangerment.
