My ex and I live several states apart. My son has just turned 11. I am wanting to see if I have a
case against him for a custody change.

Additional Details:
My ex has repeatidly refused me the right to see my son AFTER I have traveled from IL to OH for
visitation (it was agreed to prior to me leaving). He has also not provided me with my right for
visitation for school vacations (entire summers, christmas ect). He has also had my son call me to
tell me that I would not be allowed to see my son without taking my ex along with him. I have never
done anything wrong to deserve this kind of treatment and know that my ex is only using our son to
hurt me. I am also worried since my ex is a very racist person and is teaching this to my son. I
have saved notes with dates, and recordings of voicemail to support my ex also attempting to
alienate my son from me. I think that I have a pretty strong case, but I am nervous that I will
have the same turn of events as when my ex got custody in the first place.

First you must ascertain which State has jurisdiction of the case. Then it is necessary to review the last court order and determine if a change of circumstances exists. Your son's desire to live with you may be one of many circumstances that the Court would consider. Among other considerations are your child's current living situation, school, involvement in the community, location of other family; the wishes, health of you and your ex, which parent will foster the relationship with the other parent, etc. I suggest contacting a local attorney for a consultation on the best way to proceed. Best wishes!
