How can I hyphenate my daughters last name, to add my last name without her biological fathers consent?

My daughter''s father has never played a consistent role in her life. He is ordered to pay child support. He has visitation rights, but he does not adhere to the details of the court order. I have sole physical custody, and legal joint custody. We never saw a judge, all details pertaining the custody order were decided in mediation. I would not like to remove her biological fathers last name, but I would like to hyphenate it to add my married name. I do not believe her biological father will provide his consent. Can I hyphenate her name without his consent? Or do I need to file for sole physical and legal custody?
