Q: ; I have been married for 15 years. I have been a stay-at-home mother for the past ten years to raise three children.. My relationship with my husband has gone downhill for the past several years. While he spends time with friends, goes to sporting events and plays golf, I tend to the children. We have turned into roommates and something has to give. We own a home with a mortgage and my husband controls the finances and makes a good living. I want a divorce but am terrified about where the money to live will come from. We tried counseling but he refuses to listen to the counselor and says its all my fault. Can you help me?

A: When spouses lead separate lives it spells trouble. Its good that you tried counseling but if your husband is more interested in the box scores than you and your kids, its time to take action. When you file for divorce, you can ask the court to award you temporary support to maintain the status quo. For example, a court might award you temporary use and possession of your home, a car and your husband may be made to pay for all or part of the living expenses for you and the kids. The court can also award you temporary attorneys’ fees and costs based upon your need and his ability to pay. You each have the right to have a good lawyer (such as myself) represent you. The relief that you may get will be based upon many factors that include your needs and his ability to pay. Once the dust settles, you can get to the business of (hopefully) settling your case without a trial. Its tough to walk through the divorce door. Although it may feel more like walking of a cliff than through a door, the parade of horrible things that we see in our mind is usually far worse that the reality of the situation. Divorce is never easy, but we do everything we can to make a difficult and sometimes painful process more bearable.
