Can I Get My Grandchild?
Lee Borden

Q.

When a child is taken away from a parent for missing too much school and put in a foster home, can the grandparent's step in and go for that child?

A.

Good for you. In order for the child to be placed in a foster home, in all likelihood that means the court has already declared the child dependent, meaning the biological parents no longer have the right to object to your becoming custodian. Talk to your lawyer about whether you could petition the court to have the child live with you. Most judges I know would much rather have the child live with a loving and responsible grandparent than place the child in a foster home.
