Effective October 1, 2008, "custody" is no longer the law in Florida. The Florida legislature changed the law so that divorcing parents are both afforded an opportunity to enjoy frequent and continuing contact with their child or children. This is a substantive change in the law and so it should only affect cases filed after October 1, 2008 however it is my experience that most Judges apply the post October 1, 2008 philosophy in deciding cases sometimes even if filed pre October 1, 2008. The enactment of the new law in and of itself does not give rise to a substantial change in circumstances which is still necessary to entitle a parent to a modification of the original parenting sections of your final judgment. Nonetheless, the new law helps to ensure that both parents have equal access to the child or children.
