GRANDPARENTS VISITATION RIGHTS IN ORANGE COUNTY DIVORCE CASES
Under California law, distinctions are made between the rights of grandparents with respect to visitation of grandchildren or deceased parents and situations involving biological parents who are still alive. Further distinctions are drawn between grandchildren whose parents are married versus those with divorced parents.
Family Code, Section 3102 and 3014 outline the rights and opportunities for grandparents to seek visitation rights with their grandchildren. Typically, grandparents have no right to petition the court for visitation with minor grandchildren while the kid's parents are married unless certain relationship tests are met.
The most important consideration is the interests of the child in having visitations with the grandparent against the right of the parents to exercise their parental authority.
