When you are filing divorce in Orange County, and you have children. Custody concerns can arise during the divorce process. How is custody decided?
With any family law action (divorce, legal separation, paternity), a mediator will be assigned to your case by the court. The court provides a qualified mediator to mediate these issues. During this process, attorneys are not allowed to be present. It is the mediator's job to encourage an agreement in regards to custody and visitation. If an agreement is not reached, this mediator will make a recommendation to the court.
The mediator may interview the children during this process, and upon recommendations each party can dispute or request the order be made by the court.
