Does Florida Allow a No Fault Divorce?

Florida is one of 49 states in the USA that allow for a no-fault divorce.  With these divorces the dissolution of a marriage does not require an allegation, or “proof of fault”, of either party to be shown. Several common reasons for no-fault divorce include: incompatibility, irreconcilable differences, and irremediable breakdown of the marriage.

To file for a divorce in Florida you must be a resident of the state for at least 6 months prior to and must be filed in either the county where the defendant resides; or the county where the spouses last lived together prior to separating.  In cases of an uncontested divorce you will need a marital separation agreement and a short hearing is required. With the help of a skilled divorce attorney the process can take as little as 30 days.
