Steven Bishop, experienced San Diego divorce lawyer, handles family law matters and divorce law in San
Diego including child custory and support cases in Southern California, explains
various divorce myths.
The court looks at these cases - case by case. But the first
is that men never get custory. People come in with preconceived notions, and this
just isn't true. In today's society, both parties are equal.
Another one is that each party automatically has to pay half the debt. There are
numerous exceptions where the court does not require a wife or husband to equally share debt
depending upon the support agreement, as it would be to much to require that party to pay
50% of consumer debt when they will have a tough time surviving after paying
support.
Another one is that, if we sell the house we get to divide the total
minus the broker fees and closing costs. This again is case by case, but if one party were to
buy out the other, they would typically be required to pay half the equity, with no
deductions.
Another one is that spousal support is taxable to the recipient in
California.
