I conducted a Pro Se mediation today. That means the mediation did not include attorneys. The sometimes-agonizing thing about mediation is that one party or another seriously needs the help of an attorney. They may be mentally outgunned or are physically intimidated by the other side. As a mediator I must be absolutely neutral. Also, for mediation, I take off my lawyer had and put on the mediator hat. That severely limits and/or eliminates my ability to provide the advice I am used to giving. I must be absolutely unbiased and that means not becoming lopsided in my help.
Today, I say someone badly needing help and I could not help them like I wanted to. I did my best, within ethics, and sent them on their way after a completely unproductive mediation
