Common Divorce Myths

The Buffalo divorce attorneys of the Venzon Law Firm have come across a lot of common myths and misconceptions that people have about divorce.  If you are considering a divorce, a family lawyer will be qualified to address these.

Some of the most common myths include:

  • Myth #1: "I do not need a lawyer."

Hiring a divorce lawyer is not a requirement but it is recommended.  A divorce lawyer is experienced with each aspect of divorce law.  He or she will review residency requirements to be sure you are eligible for divorce in your state.  The grounds for divorce must also follow state law.  A good family lawyer will aid you in making the process as stress-free as possible for you and your family.

  • Myth #2: "The woman always gets custody of the children."

False.  A couple may decide that the father would be the better custodial parent.  In cases where this is contested, a judge will resolve the issue according to what the children’s best interests are. 

  • Myth #3: "You should not get divorced if you have children."

Children thrive in a loving, safe, and peaceful environment.  Abuse, violence, mental issues, and legal infractions can be overwhelming to a child and will negatively affect their well-being. 

  • Myth #4: "I can move anywhere and file for divorce."

Not true.  Most states have residency requirements.  In New York, for example, you or your spouse must be a resident of the state for at least two years.  There are additional requirements for residency.  A qualified divorce attorney can explain residency requirements and what they mean for your individual case.
