Mutual Benefit Group, which issued the commercial general liability policy to Wise M. Bolt Co. Inc., successfully argued that the CGL did not cover the $115,000 arbitration award to Herbert and Elaine Tracey. &quot;The repair and replacement damages awarded as a result of Bolt's poor performance are simply a cost of doing business, not a component of the insurance objective of shifting risk,&quot; U.S. District Judge William M. Nickerson wrote in granting summary judgment for Mutual Benefit last week, ending a seven-year legal dispute.
